A 29-year-old Pegs Creek man has denied assaulting a staff member at a Karratha nightclub in February and leaving him with a badly broken nose. Kyle Hayward pleaded not guilty to three charges in Karratha Magistrate’s Court last Wednesday, including one count of with intent to harm, doing an act causing bodily harm and two counts of failing to comply with a prohibition order. Police alleged on February 22 Mr Hayward was escorted from the Evolution Lounge Bar premises on Warambie Road in Karratha by security staff around 12.50am after he refused to leave when asked. It was alleged once outside the premises, without any warning, Mr Hayward punched a staff member in the face, resulting in the 34-year-old male victim being taken to Karratha Health Campus for treatment. As a result of the punch, the victim suffered a broken nose which requires ongoing treatment. The maximum sentence for one count of with intent to harm, doing an act causing bodily harm is 20 years imprisonment. Police also allege on the same night Mr Hayward breached a current liquor prohibition order he was subject to that was issued in September 2018. The order stated Mr Hayward was prohibited from entering any licensed premises within WA for a period of three years. The penalty for failing to comply with the prohibition order without reasonable excuse is $10,000. Mr Hayward was arrested on March 10 by Karratha Detectives following an investigation into the assault and was remanded in custody. He is due to face court again on August 19 via video link from Roebourne Regional Prison.
