Exploitation accused gets internet ban

A 26-year-old man accused of more than 20 charges including possessing child exploitation material has been released on bail. Tyler Foale appeared before the Karratha Magistrate’s Court facing two counts of involving a child in child exploitation and 16 charges of using electronic communication with intent to expose a person under the age of 16 to indecent matter. He is also charged with two counts of exposing a child under 13 to indecent matter, one count of a threat with intent to compel the doing of an act and one count of without consent distributing an intimate image of another. Police allege that the incidents took place in March this year. Mr Foale’s lawyer Adam Hammond requested bail for Mr Foale to live in Esperance and suggested a condition limiting Mr Foale to just using a phone for internet banking and legal advice. But Magistrate Michelle Ridley said there were concerns with the accused having access to a phone. “Banks are still open, he will have to go into them, if that’s inconvenient too bad,” she said. Concerns were raised by the prosecution that the accused was a flight risk with the only thing keeping him in WA was his son. Mr Foale was released on a $10,000 bail with a $50,000 surety. Ms Ridley set several conditions for the bail, including signing a statutory declaration that he does not hold a passport and is prevented from holding one. Other conditions included that he did not contact the alleged victims and their family or friends and was not allowed within 10km of the shire where the alleged victims live. “You are not to possess or use a device with access to the internet. You are going to have to go analogue, old school, that’s your problem.” Mr Foale is due to reappear before the court on October 14.
