Defamation case under way between Canning mayor and ratepayer

City of Canning mayor Patrick Hall was the target of a concerted effort to undermine his credibility by a ratepayer, a court has been told, forcing him to abandon his tilt at Federal politics. Proceedings began in Perth’s Supreme Court this week before Justice Marcus Solomon in a defamation case between Mr Hall and Richard Aldridge, a former president of a local ratepayers association. Mr Hall is suing Mr Aldridge over a series of social media posts and comments made at council meetings. He has engaged high-profile lawyer Martin Bennett, who most recently made his closing submissions in the blockbuster defamation case between Brittany Higgins and Senator Linda Reynolds, where he acted for the senator. Mr Aldridge is representing himself and has not yet given evidence. On Tuesday, the court was told Mr Aldridge intends to plead on the defence of truth and has also lodged a counterclaim for collateral abuse of process against Mr Hall. PerthNow previously reported a writ lodged with the Supreme Court detailed 33 incidents of alleged defamation from April 13, 2021, to March 2022. Mr Hall alleges complaints made to the Local Government Standards Panel, social media posts and deputations at council meetings had become “unrelenting attacks” and were “targeted” and malicious”. Social media posts by Mr Aldridge were shown to the court, with many of them alleging Mr Hall had not been complying with his role under the Local Government Act when he endorsed candidates in the lead-up to the 2021 local government elections. Mr Hall publicly endorsed several candidates on his own social media, including current deputy mayor Amanda Spencer-Teo. Mr Hall told the court the defendant had been advised by multiple sources there was “nothing inappropriate” about endorsing candidates at a local government level. On the second day of evidence this week, the mayor said his legal action had led him to drop out of a bid for Federal politics this year. He said while having never been a member of a political party previously, an “opportunity came up” in the seat of Tangney to nominate for the Liberals. “When I received the form to fill out, specifically in the form it asks you to address matters that would be potentially embarrassing to the party and particularly civil matters,” he said. Mr Hall recalled a conversation with WA Liberal party director Simon Morgan, in which he had disclosed the Supreme Court action. “I could tell from the conversation that was pretty much a knockout blow,” he said.
